1. Privacy Policy

Thank you for visiting our website. In the following, we would like to let you know how we handle your data pursuant to Art. 13 of the General Data Protection Regulation (GDPR).

The controller for the data collection and processing depicted below is the body listed in the legal notice.

IP address storage

We store the IP address transmitted by your web browser – strictly linked to the purpose at hand – for a duration of seven days. This is in the interest of being able to identify, limit and resolve attacks on our website. Once this period has ended, we erase or anonymise the IP address. The legal basis for this is Art. 6 (1) (1) (f) GDPR.

Usage data

When you visit our website, our web server temporarily stores usage data for statistical purposes in a log so we can improve the quality of our website. This data set consists of

• the page from which the file was requested,
• the name of the file,
• the date and time of the request,
• the data quantity transferred,
• the access status (file transferred, file not found),
• the description of the type of web browser used,
• the IP address of the accessing computer, abbreviated so it cannot be linked to a specific person.

This log data is only stored in anonymised form.

2. Transmission of data to third parties

Transmission of data to third parties

As part of contract processing under Art. 28 GDPR, we transmit your data to service providers who support us with operating our website and the associated processes. Our service providers must follow our instructions rigorously and are subject to the relevant contractual obligations. We use the following service providers: PUNKTE+STREIFEN, Zeugner und Dietrich GbR.

Transmission of data to third countries

On occasion, we send personal data to a third country outside the EU. In each instance, we take care to ensure an appropriate level of data protection.

In the case of Google Analytics (USA), there is an appropriate level of data protection due to the corresponding participation in the Privacy Shield agreement (Art. 45 (1) GDPR).

3. Cookies

Cookies

We use cookies on our website. Cookies are small text files that are stored on your terminal device and can be read. A distinction is made between ‘session cookies’, which are erased as soon as you close your browser, and ‘permanent cookies’, which are stored beyond the individual session. Cookies may contain data that enables the device you use to be recognised. Some cookies may also only contain information on certain settings that cannot be linked to a particular person.

We use session cookies on our website. This processing occurs on the basis of Art. 6 (1) (1) (f) GDPR and in the interests of optimising/enabling user guidance and adjusting the depiction of our website.

You can adjust your browser’s settings so you are informed when cookies are stored. This makes the use of cookies transparent. You can also delete cookies at any time via the relevant browser setting and prevent new cookies from being stored. Please note that this may prevent our website from being displayed in the best possible way and that some features may no longer be available on a technical level.

4. Tracking tools

Google Analytics

We create pseudonymous usage profiles using Google Analytics so we can shape our website to suit needs. Google Analytics uses cookies that can be stored on your terminal device and read by us. This enables us to recognise repeat visitors and count them as such. Data is processed on the basis of Art. 6 (1) (1) (f) GDPR and Section 15 (3) German Telemedia Act and in the interests of learning how often our website is accessed by various users.

The information on your use of the website generated by the cookie is generally transmitted to a Google server in the USA and stored there. As we have activated IP anonymisation on this website, however, Google truncates your IP address within a European Union member state before doing so. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA (an appropriate level of data protection is met under Art. 45 (1) GDPR via Google’s participation in the Privacy Shield) and truncated there. In addition, we have concluded a contract processing agreement with Google Inc. (USA) under Art. 28 GDPR. In line with this, Google may only use all the information for the strict purpose of evaluating our website for us and compiling reports on website activity.

You can use a contact form to get in touch with us. To use the contact form, we need your title, first name(s), surname, country and email address. You are welcome to share other details but do not have to.

CONSENT

By submitting the contact form, you consent to the data you have provided being recorded electronically and stored. The legal basis for the processing is Art. 6 (1) (1) (a) GDPR. We solely use your data to process your enquiry. You may revoke your consent at any time, e.g. by emailing info@landguth.de.

6. Applications

Applications

We process your personal data in line with the applicable provisions of data protection legislation on the basis of Section 26 of the New German Federal Data Protection Act. We exclusively process the data you have given us within the framework of your application for the process of candidate selection; data is not processed for purposes other than this.

You determine the scope of the data that you would like to send us as part of your online application. Applications are submitted to our HR department, which handles them as quickly as possible. Generally, applications are forwarded to the head of the relevant specialist department within our company. Your data is not disclosed beyond this. Your information is handled in confidence at our company. In the event that your application was not successful, your documents will be deleted after six months.

If we may consider your application for other, or future, vacancies, please state this on your application. In this instance, we process your data on the basis of Art. 6 (1) (1) (a) GDPR.

7. Embedded Vimeo videos

Vimeo videos

Our website incorporates video player services provided by Vimeo, Inc., 555 West 18th Street (New York), New York 10011 (www.vimeo.com). The videos are embedded into our website as an iFrame. When you access our website, a connection is made between your browser (terminal device) and Vimeo’s servers. Under certain circumstances, this may involve data concerning you, e.g. your IP address and the terminal device used to access the page, and about your activities being processed. By accessing the video and engaging in further interactions with the video player service, Vimeo may process further information about you, for instance to evaluate your viewed videos or your interests.

Finally, Vimeo uses web tracking methods on its own website and within its video player service, regardless of whether you have registered with Vimeo or are signed in to Vimeo. Unfortunately, we have no influence over Vimeo’s web tracking methods and the services connected.

Please note that it is impossible to prevent Vimeo from using your profile data to evaluate your approximate location, interests, videos accessed, and so on. We have no impact on the processing of your data by Vimeo and the associated services.

8. User’s rights

Your rights as a user

When your personal data is processed, the GDPR grants you the following rights as a website user:

1. Right of access (Art. 15 GDPR):

You have the right to request the immediate rectification of incorrect personal data concerning you and, if applicable, the completion of incomplete personal data.

In addition, you have the right to request that personal data concerning you is erased without delay, provided none of the reasons listed individually under Art. 17 GDPR apply, e.g. if the data is no longer required for the purposes pursued.

3. Right to restriction of processing (art. 18 GDPR):

You have the right to request that processing be restricted if one of the requirements detailed under Art. 18 GDPR is met – e.g. if you have objected to the processing – for the duration of any checks.

4. Right to data portability (Art. 20 GDPR):

In certain cases, as listed individually in Art. 20 GDPR, you have the right to receive personal data concerning you in a structured, common and machine-readable format, or to request the transmission of this data to a third party.

5. Right to object (Art. 21 GDPR):

If data is collected on the basis of Art. 6 (1) (1) (f) GDPR (data processing to safeguard legitimate interests), you have the right to object to the processing at any time for reasons arising from your particular situation. In this instance, we will cease processing the personal data, unless there are demonstrably compelling reasons worthy of protection to process the data which override the interests, rights and freedoms of the data subject or if the processing serves to assert, exercise or defend legal claims.

6. Right to lodge a complaint with a supervisory authority

Under Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of the data concerning you breaches the provisions of data protection legislation. In particular, the right to lodge a complaint may be exercised towards a supervisory authority in the member state in which you reside, in which you work or the place of the alleged breach.
